WORKERS' COMP GUIDE
ACCIDENT REPORTS
If you suffer an injury that occurs during the course of your employment, please fill out an accident report here on the portal ASAP, even if you think you will not see a doctor or miss any days of work. This will protect you, should the injury get worse at a later time. (The Accident Report form can be found under the "Workers' Comp" dropdown menu.)

If you note on the report that you plan on seeing a doctor, Company Management will file a claim with the insurance company and will send you a letter with your claim details.
If you note on the report that you do NOT plan on seeing a doctor, Company Management will keep the report on file but will NOT generate a claim number. If you later decide to see a doctor for this injury, please contact Company Management to receive a letter with your claim details.

SEEKING TREATMENT FOR A WORKERS' COMP INJURY
Please always use the Workers’ Comp insurance policy and claim number when seeking any medical treatment for the injury (including at the doctor’s office, at physical therapy, for imaging such as X-rays, etc). Never provide your personal health insurance details when being treated for a work-related injury.

If you need help identifying a medical provider who accepts Workers' Comp, please feel free to contact Company Management. Most company members at WICKED see either Dr. David Weiss or Dr. Melody Hrubes for orthopedic injuries and Dr. Louis Galli for foot injuries. Their contact information can be found on the Doctor List on the portal homepage.

MISSING WORK DUE TO A WORKERS' COMP INJURY
If you miss any performances due to a work-related injury, you may be eligible for benefits through Workers’ Comp and/or, if you are an AEA member, the AEA Supplemental Benefit.

WORKERS' COMP BENEFITS

Have a 7-day waiting period. But if you lose more than 14 days of work, lost wage benefits start from the first day you missed work.

Are tax-free.

Are calculated as 2/3 of your average weekly wage, up to the NY maximum weekly rate (currently $1,171.46 per week until the next increase on July 1, 2025).

Are paid by the insurance company, so please contact the adjuster assigned to your Workers' Comp claim if you have any questions.

To receive either of these benefits, you will need to provide a doctor’s note attesting that you missed each of those performances due to a particular work-related injury. If you do not plan on getting a doctor’s note for missed performances, you may use accrued sick days to help make up for docked pay by contacting your supervisor (in the case of AEA members, please contact Company Management).
If you work a partial work day (i.e. you miss 1 show on a 2-show day or you miss a performance but attend a rehearsal that same day), Company Management will automatically pay out accrued sick days to make up for docked pay, as Workers’ Comp and the AEA Supplemental Benefit only cover when you miss a full work day.
Should the injury require any time off or affect your ability to perform 8 times per week, you may request an unpaid medical leave by contacting Company Management.
AEA MEMBERS
Per AEA Rule 33(I), you may request a leave of any length of time up to 12 months if supported by a doctor’s note. The Producer will use best efforts to relate the leave to the nature of the injury but may require the leave to be at least 3 months in length to accommodate the needs of the production, including the proper coverage of your track/role.

Should you return to work prematurely or if the same injury recurs, Actors may request one extension of the leave and/or one additional leave. The Producer may limit total leaves for a single work-related injury to a 12-month period.
